1.1 These Terms and Conditions (“Terms”) apply to your use of the Volkano South Africa website located at za.volkano.com (the “Website”) and govern the sale of products by SMD Technologies Proprietary Limited through the Website.
1.2 In these Terms, “we”, “us” and “our” refer to SMD Technologies Proprietary Limited, a private company incorporated in the Republic of South Africa with the following details:

1.3 By visiting the Website, creating an account or placing an order, you agree to be bound by these Terms. If you do not agree, you must not use the Website or place any orders.
1.4 These Terms are intended to comply with South African law, including the Consumer Protection Act 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), and the Protection of Personal Information Act 4 of 2013 (“POPIA”). If there is any conflict between these Terms and mandatory provisions of law, the law will prevail.
- Use of the Website
2.1 You may use the Website for lawful purposes only. You may view, download and print content for your own personal, non‑commercial use. You may not copy, reproduce, distribute, modify, publish, resell or exploit Website content for commercial purposes without our prior written permission.
2.2 You must not:
- upload or transmit any unlawful, harmful, threatening, abusive, defamatory, obscene, hateful or otherwise objectionable material;
- introduce any viruses, malware, harmful code or attempt to gain unauthorised access to the Website or our systems;
- use any automated system or software to extract data or content from the Website; or
- impersonate another person or provide false information.
2.3 We may suspend or terminate your access to the Website without notice if we reasonably believe that you are in breach of these Terms or applicable law.
- Changes to the Website and Terms
3.1 We may modify, add to or remove these Terms at any time. Updated Terms take effect when posted on the Website. Your continued use of the Website after changes are posted constitutes your acceptance of the updated Terms.
3.2 We may suspend, modify or discontinue the Website, or any part of it, without notice. We will not be liable for any loss arising from such suspension or discontinuation.
- Intellectual property
4.1 All content on the Website (including text, images, logos, product names and descriptions, graphics, videos and software) is owned by or licensed to SMD Technologies and/or the Volkano brand and is protected by copyright, trade mark and other intellectual property laws.
4.2 You may not use our product names, images, logos or descriptions in unauthorised sales listings, advertisements or third‑party platforms without our prior written consent.
- Product information and availability
5.1 We take reasonable steps to ensure that information on the Website is accurate and up to date, but errors may occur. Product images are for illustrative purposes; actual colours, finishes and details may vary depending on your screen or minor production changes.
5.2 Displaying a product on the Website does not guarantee availability. Stock levels may be limited and certain items may be discontinued or out of stock at any time. If we cannot fulfil part or all of your order, we will notify you and offer a suitable remedy (for example, a replacement product or refund for the unavailable item).
5.3 Some products may require pairing, configuration, firmware updates or installation of third‑party apps or services (for example, music or video streaming services). We are not responsible for the availability, performance or continued operation of any third‑party service or app, or for changes made by third‑party providers.
- Prices, errors and promotions
6.1 All prices on the Website are quoted in South African Rand (ZAR) and include VAT unless otherwise stated. Delivery charges, if any, will be shown separately at checkout.
6.2 We reserve the right to change prices, delivery fees and promotions at any time without prior notice. The price applicable to your order is the price displayed at the time you place your order and we accept it.
6.3 We reserve the right to correct obvious errors in price or description. If you have already placed an order at an incorrect price, we will notify you of the correct price and ask whether you wish to continue. If you choose not to continue, we will cancel the order and refund any amount already paid.
6.4 Promotional offers, discount codes and vouchers may be subject to additional terms, including eligibility criteria, applicable products, validity periods and maximum discounts. Promotions are not exchangeable for cash and may not be used in conjunction with other offers unless expressly stated.
- Ordering and formation of contract
7.1 Placing items in your cart does not constitute a contract. A binding agreement between you and SMD Technologies is formed only when:
- you have completed the online checkout process on za.volkano.com;
- you have paid the full order amount using a payment method accepted via our payment gateway; and
- we have accepted your order by sending you an order confirmation and/or commencing dispatch of the products.
7.2 We reserve the right to decline, cancel or limit orders at our discretion, including where:
- products are out of stock or discontinued;
- there is an obvious pricing or description error;
- your payment is not authorised or suspected to be fraudulent; or
- you have breached these Terms or applicable law.
7.3 Goods remain our property until paid for in full.
- Payment
8.1 All payments for orders placed on the Website are processed through the PayFast payment gateway. Available payment methods are those offered by PayFast from time to time (for example, major credit and debit cards and PayFast‑supported alternatives).
8.2 By submitting your payment details, you authorise PayFast and SMD Technologies to process payment for the total amount of your order, including any delivery charges.
8.3 We do not receive or store your full card details. Card data is processed securely by PayFast in accordance with its own security standards.
8.4 We may request additional information or documentation to verify your identity or payment method. This may delay dispatch until verification is completed.
- Delivery and risk
9.1 We deliver within the Republic of South Africa only, using courier partners selected by us.
9.2 Delivery fees:
- Orders with a total value of R450 or more (after discounts and before delivery fees) qualify for free standard delivery.
- Orders below R450 are charged a flat delivery fee of R80.
We may amend these thresholds and fees from time to time; any changes will be displayed on the Website and at checkout.
9.3 Standard delivery times are generally 2 to 5 business days from dispatch for most areas in South Africa. Delivery timeframes are estimates only and may be affected by factors beyond our control, such as courier delays, strikes, load‑shedding, adverse weather or peak‑season volumes.
9.4 We will deliver to the physical address provided by you at checkout. You are responsible for ensuring that the address and contact details you provide are correct and that someone is available to receive and sign for the delivery.
9.5 Risk in the products passes to you upon delivery to the address you provided (or to someone acting on your behalf). Ownership passes once full payment has been received and cleared.
- Returns, faults and warranties
10.1 Our Volkano Returns, Refunds and Warranty Policy forms part of these Terms and sets out how we handle defective goods, DOA (dead‑on‑arrival) products, warranty claims, and your rights under the CPA. In the event of any conflict, applicable law will prevail.
10.2 If you believe a product is defective, damaged or not of acceptable quality, you must follow the procedure in the Returns, Refunds and Warranty Policy and contact us promptly at returns@smdtechnologies.com.
10.3 Where the CPA applies, goods that do not meet the required standard of quality and safety may be returned within 6 months for repair, replacement or refund, subject to the conditions in the CPA and our policy.
10.4 Our Volkano Limited Warranty provides additional warranty periods for Volkano products (for example, 12 months for electronics and 24 months for Volkano backpacks) as set out in the Returns, Refunds and Warranty Policy. This limited warranty is in addition to, and not in substitution for, your statutory rights.
10.5 If you purchase a Volkano product from a third‑party retailer or e‑commerce platform (for example Takealot, Makro or other authorised retailers), your return, refund and initial warranty claim must be processed through that retailer or platform in accordance with their policies. We do not accept direct returns for products purchased from other merchants, but the Volkano Limited Warranty may still apply via that merchant.
- Electronics‑specific disclaimers
11.1 Many Volkano products are electronic devices that can store data, connect to networks, or interact with third‑party applications and services. You are solely responsible for:
- backing up any data, files, settings or content stored on devices before returning them for repair or replacement;
- removing any personal data where possible before sending devices to us or our service providers; and
- managing your own accounts and subscriptions with third‑party service providers.
11.2 To the fullest extent permitted by law, we are not liable for any loss, corruption or disclosure of data, software, settings or content stored on any device, whether occurring during normal use, failure of the device, repair, replacement, inspection or disposal.
11.3 Products must be used only with compatible power sources, chargers, cables and accessories that comply with the specifications on the product and in the user manual. Damage caused by:
- use of non‑compliant, incompatible or non‑approved accessories;
- incorrect voltage or power surges;
- unauthorised modification, tampering or repair;
is not covered by our limited warranty and may affect your rights under the CPA.
11.4 Battery life, playback time, capacity, wireless range and similar performance metrics are approximate and may vary depending on usage, settings, environment and other factors. We do not guarantee any specific performance figure beyond what is required by law.
- Limitation of liability
12.1 To the fullest extent permitted by law, and subject always to your non‑waivable rights under the CPA and other applicable legislation, we will not be liable for:
- any indirect, special, incidental or consequential loss or damage;
- any loss of profits, revenue, business, data, goodwill or anticipated savings; or
- any loss arising from your use of, or inability to use, the Website or our products,
except where such loss is directly caused by our gross negligence, fraud or intentional misconduct.
12.2 Our total aggregate liability to you for all claims arising out of or in connection with a particular order will not exceed the total amount actually paid by you for that order, except where the law does not allow such limitation.
12.3 Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our gross negligence.
- Indemnity
13.1 To the extent permitted by law, you agree to indemnify, defend and hold harmless SMD Technologies, our directors, employees, agents and service providers from and against all losses, damages, claims, liabilities and costs (including reasonable legal fees) arising from:
- your breach of these Terms or the Returns, Refunds and Warranty Policy;
- your violation of any applicable law or third‑party rights; or
- your misuse of the Website or our products.
- Privacy and cookies
14.1 We process personal information in accordance with POPIA and our Privacy Policy for za.volkano.com, which forms part of these Terms.
14.2 The Website uses cookies and similar technologies to enable core functionality, remember your preferences and analyse Website usage. You can adjust cookie settings in your browser, but certain features of the Website may not function properly if cookies are disabled.
- Governing law and jurisdiction
15.1 These Terms, their subject matter and their formation are governed by the laws of the Republic of South Africa.
15.2 Any disputes arising out of or in connection with the Website, these Terms, or any order will be subject to the non‑exclusive jurisdiction of the South African courts and, where applicable, to any ombud or tribunal having jurisdiction under the CPA or other legislation.
